Web Alert: Implementation of ECA measures at Shenzhen port within Pearl River Delta

The local authorities in Shenzhen issued a formal notice on 30 August, 2016 confirming their intention to adopt more stringent requirements on the use of low sulphur content fuel during ships berthing at Shenzhen port with effect from 01 October, 2016.
Further to the club’s previous update on implementation of ECA measures at Shenzhen port within the Pearl River Delta, the local authorities have now formally announced that vessels will be required to use fuel oil with a sulphur content not exceeding 0.5% m/m, or equivalent emission reduction measures from 1 October 2016. As advised by the local correspondents, this requirement extends to the ports of Yantian, Shekou, Chiwan, Mawan and Dachan Bay.
Where equivalent measures are to be used, except when using shore power or Liquefied Natural Gas (LNG), prior permission will need to be obtained from the Shenzhen Maritime Safety Administration and the Human Settlements and Environment Commission of Shenzhen Municipality.
Ships are required to keep relevant documents of fuel usage, such as engine log, bunker supply certificates, fuel change-over procedure and oil record onboard which shall be subject to possible inspection by local authorities.
Ships using fuel that does not meet the new requirements will be subject to penalties according to Article 106 of Air Pollution Prevention Law of the PRC. However, in certain circumstances ships may be able to apply to Shenzhen MSA for immunity or exemption. However, in order to avoid any issues or penalty, members are recommended to ensure that their vessels due for calling Shenzhen comply with relevant requirements from 1 October 2016.
