Rule 46 Disputes
If any difference or dispute shall arise between an Insured Owner and the Association out of or in connection with these Rules, or any contract between them, or as to the rights or obligations of the Association or the Insured Owner thereunder, or in connection therewith, such difference or dispute shall in the first instance be referred to and considered by the Directors.
If the Insured Owner concerned in such difference or dispute does not accept the decision of the Directors, it shall (except as provided by Rule 46.3) be referred to the decision of the High Court of Justice (Commercial Court) in London. The said Court shall have exclusive jurisdiction over the matter.
Any such difference or dispute arising under the provisions of Rule 11.2, Appendix B paragraph B.3.2 or Appendix C paragraph C.4 shall be referred to arbitration in the manner therein provided.
