News: The Judicial System in Spain and COVID-19 - an update

01 May 2020

The club has previously produced a news item on how the actions of the Spanish government to protect public health from the COVID-19 pandemic have affected the local judicial system which is available here.

On 22 April 2020 the Spanish parliament voted to extend the 'State of Alarm' until 11 May 2020. Until then, the legal and judicial position remains as we previously set out unless the government decides to amend the current state earlier.

Lawyers Aiyon Abogados have now published a very comprehensive circular where they cover, amongst other things, the following points related to the pandemic:

  • Time bars and function of courts during the State of Alarm
  • Restrictions to peoples’ movements via land, sea and air transport
  • Crew changes in ports
  • Port functions
  • Port State control activities

Please find attached the relevant circular. Members are encouraged to contact their claims handler in the club in order to identify promptly any consequences which the current situation might have on their cases.
